Agreement to terms
By using this website or engaging Grownex for services, you agree to these Terms of Service. If you do not agree, please do not use the site or submit an enquiry.
These terms apply to all visitors, clients and prospective clients who access the site or enter into a service agreement with us.
Services we provide
Grownex provides digital fundraising growth services to charities and nonprofit organisations, including paid media management, donation page conversion optimisation, donor journey automation, recurring giving strategy, analytics and attribution, and related consulting.
Specific deliverables, timelines and fees are set out in a separate proposal or service agreement agreed with the client.
Use of the website
You may use this website for lawful purposes only. You must not attempt to disrupt the site, access restricted areas, or use automated tools to scrape content without permission.
All content on this site is for general information and marketing purposes. It does not constitute professional, legal or financial advice.
Client responsibilities
Clients are responsible for providing timely access to relevant accounts, platforms and data, and for ensuring they have the right to share that information with us.
Clients must comply with applicable laws and regulations, including fundraising, data protection and advertising standards.
Fees and payment
Fees are set out in the agreed proposal or service agreement. Payment terms, including deposits, recurring fees and expenses, are described there.
We reserve the right to suspend or terminate services where payment is materially overdue.
Confidentiality
We treat client information, donor data and campaign details as confidential. We will not disclose confidential information to third parties except where required by law or with the client's consent.
Data protection
We process personal data in accordance with our Privacy Policy and applicable data protection laws. Clients must ensure they have appropriate lawful grounds for any donor data they share with us.
Intellectual property
All materials we create specifically for a client become the client's property upon full payment, unless otherwise agreed in writing. Pre-existing methodologies, templates and tools remain our property.
Content on this website, including text, images and design, is owned by or licensed to Grownex and may not be copied without permission.
Limitation of liability
To the fullest extent permitted by law, Grownex is not liable for any indirect, consequential or incidental loss arising from the use of this website or our services.
Our total liability for any claim arising from services is limited to the fees paid by the client for those services in the 12 months preceding the claim.
Termination
Either party may terminate a service agreement in accordance with the termination provisions set out in that agreement. On termination, access to client systems and data is revoked promptly.
Governing law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to these terms
We may update these Terms of Service from time to time. The latest version will always be available on this page, and continued use of the site constitutes acceptance of any changes.
